Introduction

The Marrakesh Agreement, signed on 15 April 1994 in Morocco, stands as the foundational treaty that established the World Trade Organization (WTO). This pivotal agreement marked the successful conclusion of the eight-year-long Uruguay Round of trade negotiations and fundamentally reshaped the landscape of global commerce. It replaced the provisional General Agreement on Tariffs and Trade (GATT) with a permanent, robust institutional framework designed to govern the complex and expanding realities of international trade. The agreement came into force on January 1, 1995, creating a single, integrated system of rules and obligations for its 123 signatory nations, which has since grown to include over 164 members.

Historical context and objectives

The Marrakesh Agreement was born out of the necessity to modernize the international trading system. The preceding GATT, established in 1947, had been instrumental in reducing tariffs on goods but was ill-equipped to handle the growing complexity of the global economy. By the late 20th century, trade in services, intellectual property rights, and agricultural subsidies had become major points of contention that the GATT framework could not adequately address. The Uruguay Round was launched to tackle these issues, and its culmination in the Marrakesh Agreement signified a collective will to create a more comprehensive and enforceable set of rules for world trade.

The preamble of the agreement explicitly outlines its core objectives: to raise standards of living, ensure full employment, expand real income, and boost the production and trade of both goods and services. Crucially, it also integrates the principles of sustainable development and environmental protection, while emphasizing the need to ensure that developing countries, particularly the least-developed, secure a share in the growth of international trade commensurate with their economic development needs.

Structure and core elements

A defining feature of the Marrakesh Agreement is its structure as a "single undertaking." This means that member countries must accept all the agreements as a single package, preventing them from cherry-picking which rules to follow. This ensures a uniform and consistent application of trade law across all members. The agreement itself establishes the WTO and its core functions, with the detailed rules contained in several annexes:

Annex 1A (Multilateral Agreements on Trade in Goods): This incorporates the original GATT principles and adds new agreements on agriculture, textiles, technical barriers to trade, and anti-dumping measures.
Annex 1B (General Agreement on Trade in Services - GATS): This was the first-ever multilateral agreement to establish legally enforceable rules for trade in services, such as banking, insurance, and telecommunications.
Annex 1C (Agreement on Trade-Related Aspects of Intellectual Property Rights - TRIPS): This annex sets minimum global standards for the protection of copyrights, patents, trademarks, and other forms of intellectual property.
Annex 2 (Dispute Settlement Understanding - DSU): This created a unified and more powerful system for resolving trade disputes between member nations, with legally binding decisions.
Annex 3 (Trade Policy Review Mechanism - TPRM): This established a process for regularly reviewing the trade policies of member countries to enhance transparency and understanding.
Annex 4 (Plurilateral Agreements): These are optional agreements that are only binding on the members that choose to sign them, such as the Agreement on Government Procurement.

Institutional framework and functions

The Marrakesh Agreement created a permanent institutional structure for the WTO. The highest decision-making body is the **Ministerial Conference**, which meets at least every two years. Day-to-day work is overseen by the **General Council**, which also convenes as the Dispute Settlement Body and the Trade Policy Review Body. Decisions are typically made by consensus, preserving the member-driven character of the organization.

The core functions of the WTO, as laid out by the agreement, are to facilitate the implementation and administration of trade agreements, provide a forum for ongoing negotiations, settle trade disputes, monitor national trade policies, and cooperate with other international economic institutions like the World Bank and the IMF to ensure greater coherence in global economic policy-making.

Legal significance and legacy

The most significant advancement of the Marrakesh Agreement over the GATT system is its legal and political force. The establishment of a binding dispute settlement mechanism transformed the enforcement of trade rules. Member states are subject to compulsory review and are obligated to comply with the rulings of the dispute settlement panels and the Appellate Body. This creates a more predictable, secure, and rules-based environment for international commerce.

The Marrakesh Agreement is the constitutional charter for the modern global trading system. By establishing the WTO, it profoundly shaped the world economy and expanded the reach of international law into new and critical areas of trade.
